Federal Judge Mandates Release of Abrego Garcia from Immigration Custody
A court has ruled the immediate discharge of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing confinement is without lawful basis.
"Since his return from erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," the judge wrote in her ruling.
The case stems from a mistaken deportation to El Salvador in March, which the government later acknowledged was an mistake. Following his return to the United States to answer human smuggling allegations, he was held in federal custody.
In her order, the judge pointed out that the authorities does not have a valid removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."

The legal challenge center on disputed claims. While the Trump administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he categorically disputes this claim.
